Question on cross-border data privacy and fund marketing

Been looking into fund marketing regulations for a new product, specifically around EU investors. If the fund is based out of Cayman but targets EU individuals, does GDPR apply to the marketing data collected, even if the primary data processing happens offshore? It's a bit of a grey area given the 'offshore' aspect versus the 'targeting EU citizens' part.

Ah, the Cayman-EU data privacy tango. My bet is GDPR would still be tapping its foot impatiently, regardless of where the servers are enjoying their tax holiday. It seems the 'targeting EU citizens' part is a bit like an uninvited guest at the data processing party, always managing to sneak in.

GDPR definitely applies if you're targeting EU citizens, regardless of where your fund or data processing is based. The key is the 'targeting EU individuals' part; that triggers GDPR jurisdiction.
