While they paid the fine and pivoted to exclude US persons, the core issue of defining prediction markets as 'swaps' under the CEA hasn't exactly gone away. The regulatory landscape for these types of platforms seems to be calcifying, not liberalizing. What's the realistic path for them, or any similar platform, to operate legally in the US without being limited to just 'play money' or non-financial instruments?
